Terms of Service
The agreement between you and Wapito: what the service does, what it cannot promise about WhatsApp bans, what you may not send through it, and how billing, suspension and liability work.
1. The agreement
These terms are the agreement between you and Wapito ("we", "us") for the Wapito service: the dashboard at wapito.com, the REST API at api.wapito.com, the webhook delivery system and everything documented in the API reference. By creating an account, linking a WhatsApp number or calling the API you accept them.
If you are accepting on behalf of a company, you confirm you may bind that company, and "you" means the company. Where a separate signed agreement exists between us, that agreement wins over these terms for whatever it covers.
2. What Wapito is, and what it is not
Wapito is an unofficial WhatsApp API. It links a real WhatsApp account and communicates over the same protocol the WhatsApp phone and desktop applications use. It is not Meta's official WhatsApp Business Cloud API, and Wapito is not affiliated with, endorsed by, sponsored by or certified by WhatsApp or Meta Platforms, Inc.
You accept the consequence of that. WhatsApp may restrict, timelock, unlink or permanently ban any number connected through Wapito, at its own discretion and without notice to you or to us, and neither you nor we have a right of appeal. WhatsApp may also change its protocol at any time in a way that degrades or removes functionality. Those risks sit with you, and no clause of these terms transfers them to us.
You are also responsible for your own compliance with WhatsApp's and Meta's terms for the accounts you link. If the way you intend to use WhatsApp is not permitted by WhatsApp, Wapito is not permission to do it anyway.
3. Your account
You need an account to create a channel. Keep your login credentials and your channel API tokens secret: a token is a bearer credential, anybody holding it can act as your channel, and we cannot tell a stolen token from a legitimate one. Rotate a token from the dashboard the moment you suspect it has leaked.
You are responsible for everything done through your account and your tokens, including by your own users, contractors and systems. Tell us at once if you believe your account has been compromised.
You must be at least eighteen years old and legally able to enter into this agreement, and you may not use Wapito if you are barred from doing so under applicable sanctions or export law.
4. Acceptable use and unsolicited messaging
The Acceptable Use Policy is part of this agreement, and breaking it is breaking these terms. Read it: it lists what may not be sent through Wapito and what happens when a number is reported.
Unsolicited bulk messaging is forbidden. You may message a person through Wapito only when they have asked to hear from you, or when you are replying to a message they sent you first, or when a contract or law otherwise gives you a lawful basis for that message. Buying, scraping or otherwise acquiring a list of numbers and messaging them through Wapito breaches this agreement, regardless of what local law would allow.
You may not use Wapito to evade a restriction WhatsApp has applied — including by rotating numbers to keep sending after a number has been banned for the behaviour you intend to continue.
Read the Acceptable Use Policy in full — it is the part of this agreement most likely to affect what you build.
5. Plans, payment and taxes
The Sandbox plan is free and subject to the quotas published on the pricing page. Premium is billed per channel — $24 per channel per month, or $19 per channel per month when a year is paid up front — and renews automatically until cancelled.
Payments are processed by Stripe. Prices exclude VAT, GST and sales tax, which are added at checkout where they apply. We may change prices with at least thirty days' notice by email; a change takes effect at your next renewal and you may cancel before it does.
If a payment fails we may retry it, and we may suspend the affected channels after a reasonable grace period. Quotas and plan limits may be adjusted with notice; where a change reduces what you are entitled to, it takes effect at your next renewal.
6. The free trial
Premium starts with a 5-day free trial on the first paid channel on your account. The trial is granted once per user, not once per channel: any further channel you upgrade is charged from the day you upgrade it.
You give payment details to start the trial and nothing is charged until it ends. Cancel before the last day and you are not charged at all. We may withdraw or shorten a trial where we reasonably believe it is being used to abuse the service.
7. Cancellation and refunds
You can cancel a channel at any time from the billing portal. Cancellation stops the next renewal; the channel stays on Premium until the end of the period you have already paid for and then reverts to the free plan. There is no minimum term and no cancellation fee.
Charges for a period that has already begun are not refunded automatically. Where the service was materially unavailable or a channel was unusable for a significant part of a paid period because of a fault on our side, write to support and we will refund that period in full or in part. Nothing here limits a refund right you have under mandatory consumer law.
8. Suspension and termination
You may close your account at any time by deleting your channels and asking us to delete the account.
We may suspend or terminate a channel or an account immediately, without a refund for the remaining period, where we reasonably believe it is being used for unsolicited bulk messaging, for any of the prohibited uses in the Acceptable Use Policy, for activity that is illegal, or in a way that endangers the service or other customers. Where the breach is capable of being fixed and is not serious, we will normally warn you first and give you a chance to fix it.
We may also suspend a channel where WhatsApp has banned or restricted the underlying number, where payment has failed, or where we are required to by law. On termination your data is deleted according to the retention periods in the Privacy Policy.
9. Availability and support
We aim to keep the service available and to answer support requests within the target times published on the support page. Those targets are a statement of intent, not a service-level agreement: there is no uptime commitment, no service credit scheme, and no guaranteed response time on any plan.
We may perform maintenance, change or remove features and change the engine that drives WhatsApp. Where a change breaks an existing integration, we will announce it on the changelog before it ships, except where a security issue or a change at WhatsApp's end makes that impossible.
10. Your data and your customers' data
You own your content. We process it only to provide the service, as described in the Privacy Policy, and we do not sell it or use it to train models. Where the content includes personal data of the people you message, you are the controller of that data and we act on your instructions as your processor; you are responsible for having a lawful basis and for telling those people what you do with it.
We may use aggregate, non-identifying operational statistics — request volumes, error rates, feature usage — to run and improve the service.

11. Intellectual property
Wapito, its software, documentation, generated code samples and brand remain ours. You get a non-exclusive, non-transferable right to use the service and the documentation while this agreement is in force, and you may use the code samples in your own projects without restriction.
WhatsApp is a trademark of Meta Platforms, Inc. and is used on this site only to describe what the service interoperates with.
12. Warranties and disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including fitness for a particular purpose, merchantability and non-infringement.
In particular, and without limiting the above, we do not warrant that a linked number will remain linked, that WhatsApp will not ban or restrict it, that any message will be delivered, that any endpoint will continue to be supported by WhatsApp, or that the service will be uninterrupted or error-free.
13. Limitation of liability
To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, for loss of profit, revenue, goodwill or anticipated savings, or for the loss of, or damage to, any WhatsApp account or phone number — including a ban, restriction or unlink applied by WhatsApp.
Our total aggregate liability arising out of or in connection with this agreement is limited to the amount you paid us for the service in the three months immediately before the event giving rise to the claim.
Nothing in this agreement excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded.
14. Indemnity
You will indemnify us against claims, damages and reasonable costs arising from your use of the service in breach of this agreement or the Acceptable Use Policy — in particular claims brought by people you messaged without a lawful basis, and claims arising from content you sent through the service.
15. Changes to these terms
We may update these terms. Where a change materially reduces your rights we will give at least thirty days' notice by email or in the dashboard before it takes effect, and you may cancel before then. Every version carries the date it was last reviewed, at the top of this page.
16. General
If any clause is held unenforceable, the rest stands. A failure to enforce a clause is not a waiver of it. You may not assign this agreement without our consent; we may assign it to a successor of the business. These terms, the Acceptable Use Policy and the Privacy Policy are the entire agreement between us on their subject matter.
17. Governing law and disputes
This agreement is governed by the law of [jurisdiction — to confirm], and the courts of [jurisdiction — to confirm] have exclusive jurisdiction over any dispute arising out of it. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in.
